These are described below and illustrated by examples from the case studies. Transparency Transparency in national policy measures has long been recognized as an important first step in any efforts to make markets more open. As a result, all the main WTO agreements dealing with regulatory policy include transparency requirements. 2 Transparency provisions require, at a minimum, that all statutory measures affecting the relevant sectors of the economy are notified. It is standard practice to include a requirement on notification of statutory measures in trade agreements, but some provide for notification when the legislation is adopted (such as GATS) and some require prior notification of any legislation (such as in the TBT Agreement, NAFTA or the EU provisions on services).

Multilaterally, Poland became a founding member of the EU–POLAND ASSOCIATION AGREEMENT 39 WTO in 1995 after participating in the Uruguay Round as the only ‘‘developed’’ country without any bound rates of tariffs. The main Polish commitments for trade in goods in the WTO were to bind about 94 per cent of all tariffs, to reduce tariffs on industrial products by 38 per cent and on agricultural products by 36 per cent over six years, and to reduce domestic support for agriculture (Michalek, 2000). A key consideration during the Uruguay Round was to avoid bound rates below current EU bindings in order to avoid compensation to trading partners after accession to the European Union.

The GPA does, however, provide a reference point for assessing the various provisions on public procurement in the RTAs. As with the GATS, the GPA consists of a framework agreement and schedules determining coverage. So it is important to consider these schedules when assessing the degree to which RTAs are more or less extensive than the GPA. Some regional agreements, such as the Europe Agreement between the EU and Poland and other Central and East European countries, include central as well as local or provisional government; others, such as the EU–Mexico RTA, do not.
